Agreement to Terms

By downloading, installing, or using Carve ("the app"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the app.

Description of Service

Carve is a ski tracking application that uses GPS to record your skiing and snowboarding activities, including runs, lift rides, speed, altitude, and other statistics. The app is designed for recreational use and personal tracking purposes.

Key features include:

GPS-based activity tracking
Automatic lift ride detection
Speed heatmap visualisation
3D replay with real terrain elevation and satellite imagery
Run-by-run comparison with synchronised replay
Activity replay and visualisation
Import from other ski tracking apps
Optional iCloud backup

Account Registration

To use Carve, you must create an account using Sign in with Apple or Google Sign-In. You are responsible for:

Maintaining the confidentiality of your account
All activities that occur under your account
Notifying us of any unauthorized use of your account

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the app.

Acceptable Use

You agree to use Carve only for lawful purposes and in accordance with these Terms. You agree NOT to:

Use the app while skiing in a manner that endangers yourself or others
Rely solely on the app for navigation or safety decisions
Attempt to reverse engineer, decompile, or modify the app
Use the app to violate any applicable laws or regulations
Interfere with or disrupt the app's functionality or servers
Attempt to gain unauthorized access to our systems
Use the app to harm minors in any way

Safety Disclaimer

⚠️ IMPORTANT: Carve is a recreational tracking tool, not a safety device.

Always prioritize your safety and awareness of your surroundings while skiing or snowboarding
Do not look at or interact with your phone while actively skiing
The app should not be used as a substitute for proper ski safety equipment, training, or judgment
Follow all resort rules, signage, and instructions from ski patrol
Weather, terrain, and conditions can change rapidly — always use your own judgment
Wear appropriate safety gear including a helmet

By using this app, you acknowledge that skiing and snowboarding are inherently dangerous activities and you assume all risks associated with these activities.

GPS and Location Accuracy

You understand and acknowledge that:

GPS accuracy varies based on device, conditions, weather, terrain, and satellite visibility
Statistics provided by the app (speed, altitude, distance) are estimates and may not be perfectly accurate
Mountain terrain, trees, buildings, and weather can significantly affect GPS signal quality
Do not rely on GPS data for critical navigation or safety decisions
Speed readings should not be used to verify compliance with resort speed limits or regulations

3D Replay and Terrain Data

The 3D Replay feature uses terrain elevation data from third-party sources and satellite imagery to reconstruct an approximate 3D view of the mountain. You understand and acknowledge that:

Terrain elevation and satellite imagery are approximations and may not perfectly represent actual conditions
3D visualisations are for recreational and illustrative purposes only
Terrain data availability and resolution may vary by location
An internet connection is required to download terrain data for the first replay of a given area

Lift Detection

The automatic lift detection feature:

Uses publicly available data from OpenStreetMap and may not include all lifts at all resorts
May occasionally misidentify lift rides or fail to detect them
Should not be relied upon for any purpose other than recreational tracking

Data Import

When importing data from other apps:

You are responsible for ensuring you have the right to export and import such data
Imported data accuracy depends on the source app and file format
We are not responsible for data loss or corruption during import

iCloud Backup

The optional iCloud backup feature:

Stores your ski data in your personal iCloud account
Is subject to Apple's iCloud Terms of Service
Requires sufficient iCloud storage space
May not be available in all regions

We are not responsible for data loss due to iCloud service interruptions or your iCloud account issues.

Intellectual Property

The app and its original content, features, and functionality are owned by Angel Terziev and are protected by international copyright, trademark, and other intellectual property laws.

Open Source Components

Carve uses open source software components, which are subject to their respective licenses. See the Acknowledgements section in the app for details.

OpenStreetMap Data

Ski lift data is sourced from OpenStreetMap contributors and is available under the Open Database License (ODbL). © OpenStreetMap contributors.

Terrain Elevation Data

3D Replay terrain data is sourced from Open Topo Data using the SRTM30m dataset, which is publicly available from NASA's Shuttle Radar Topography Mission.

Your Content

You retain ownership of your ski activity data. By using the app, you grant us a limited license to process this data solely for providing app functionality.

In-App Purchases

Carve offers optional donation-based in-app purchases to support development. These donations:

Are entirely voluntary
Do not unlock any additional features (all features are free)
Are non-refundable, subject to Apple's refund policy
Are processed securely through Apple's App Store

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

The app will be uninterrupted, secure, or error-free
GPS data will be accurate, reliable, or complete
The app will meet your specific requirements
Any errors in the app will be corrected
The app will be compatible with all devices or iOS versions

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANGEL TERZIEV, HIS AFFILIATES, OR LICENSORS BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, revenue, data, or goodwill
Personal injury or property damage arising from your use of the app
Any damages arising from GPS inaccuracies or app malfunctions
Any damages resulting from unauthorized access to your data
Any damages exceeding the amount you paid for in-app purchases, if any

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK.

Indemnification

You agree to defend, indemnify, and hold harmless Angel Terziev and his affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use or misuse of the app
Your violation of these Terms
Your violation of any third-party rights
Any injury to yourself or others while using the app or engaging in skiing/snowboarding activities
Your violation of any applicable laws or regulations

Termination

We reserve the right to:

Terminate or suspend your account at any time for any reason, including violation of these Terms
Discontinue the app or any part of it at any time with or without notice
Modify these Terms at any time

You may terminate your account at any time by deleting it through Settings > Account > Delete Account.

Upon termination, your right to use the app ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, for significant changes, through the app or via email. Your continued use of the app after any changes constitutes your acceptance of the new Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the app shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Bulgaria.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver

The failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Angel Terziev regarding the use of the app and supersede any prior agreements.
